A San Diego limousine operator has been named as the Operator of the Year by the International Taxicab Livery Association. Limousines by Linda was chosen last month from hundreds of livery services and taxicab companies in the international group. A press release from the ITLA highlighted the local operators commitment to quality, going as far as to install Global Positioning Satellite systems in all company vehicles. By marketing itself as a boutique ma department store-like market, the, company brings a level of personal service not found at other companies, Jennings said. Other factors in the selection were extensive, preventive maintenance on the vehicles and fax or computer verification of reservations, she said.

Squalls ripped through the southern Pacific yesterday, knocking down at least three of the 13 yachts still competing in the BOC round-the-world solo race. An American, Arnet Taylor Jnr, and two Britons, Robin Davie and Harry Mitchell, reported being knocked over. Christophe Auguin, of France, turned in another 300-mile day to remain solidly in the lead. His countryman Jean Luc Van den Heede, however, sailed a straighter course to cut Auguins advantage down to 142 miles from 239 just two days earlier.

I listen to my heartbeat, to my breath, to my wifes breathing beside me, and I think, every night, of my father, a thousand miles to the north, breathing toward sleep, of my children breathing on the other side of the house. I listen to traffic, to wind, to whatever moves. Sometimes I can smell one of the blossoming perfume-trees that open their flowers at night. Maybe I pretend their perfume is becoming my body as I slip away into just breathing, away into the scurry of lizards and the mitten-like beating of moth wings. Sometimes I catalog shadows: lost teeth, a mattress stuffed with hair, the unwashed socks of someone who moved away years ago, painted-over windows, gestures that mean I am desperate for love, the ample darkness at the core of any solid thing. And so I am lost, and so I fall away, I peel away, I strip myself away and I myself am stripped away, falling into absence like an empty tide. Or maybe as I sleep I am rising in an elevator which stops between floors and just hangs there. Silence. Then maybe all the others on the crowded elevator start chattering a deafening cacophony. Maybe their clothes look like feathers as the elevator opens on nothing and they jump up, laughing, and seem to fly away in every direction as I look down at my unchanged body, as I step out into nothing (I cant stop myself), as I step out into silence, into weightlessness and perfect blue.You remember a woman wrapped in white, sitting in a rocking chair beside a dark window. She rocks and looks out while she tells stories about people youve never heard of before, and she complains about windows and outside and white. Her breath clouds the dark window she looks hard into to try to see you in the reflection, standing behind her. You move around behind her, unable to decide what to do with your hands, with your body. You feel like touching her gently, saying something inane and untrue: it will be all right. But you dont talk. And she sings to you, songs you remember as she sings them. She tells stories about relatives and childhood. About cellars and crawl spaces. Who else can breathe underwater? She turns toward you and asks again. Who else do you know who can breathe underwater? She says she could live there, underwater. She says maybe shed prefer to live there, away from all this weather. She asks if you remember nights you slept beneath her bed with your brothers and sisters. You remind her you were an only child. She insists you must remember. You breathed each others breath. I tossed and dreamed alone above you. And you see now Ive grown too old to live, too old to love, too old to sleep. Theres nothing more to say. Where was your father? You cant remember anything. And so, as she talks on, you take off your clothes and lie down on that chilly floor, curl up and try to fall asleep, curl up and fall asleep until you arent afraid of waking.

With gusts of over 30 knots blasting over the Holy Loch, several dinghy sailors found it nigh on impossible to get their boats righted in the difficult conditions. In the slow dinghy class, Strathclyde Loch Sailing Clubs Crawford Reid produced two firsts in his Albacore, putting him out in front as a clear leader in the 13-strong class and Alan Milton in Pepsi took two more decisive wins in the Sigma 33 class. Cove Sailing Clubs Alan Harper in Pied Piper sealed a championship win with a second and fourth, while Clyde Cruising Clubs Donald Sharp had two good wins and lifted the IRC Class 2 crown.

Amistar Sells Unit To SMS: Amistar Corp., a San Marcos-based public company traded on Nasdaq as AMTA, sold its contract manufacturing division to SMS Technologies, a San Diego-based firm thats in the same business, for an undisclosed price. Amistar President Stuart Baker said the company decided to get out of the contract manufacturing business and to develop its distributed delivery networks business that services the retail pharmacy industry. SMS and Amistar plan to make presentations to Amistars six largest customers in hopes of retaining them at SMS Sorrento Mesa plant. Privately held SMS has some 25 regular, large-volume customers, and many smaller customers that use the plant to produce new products.

Thanks to the global reach of e-mail, blogs, and shared sites such as MySpace and YouTube, damaging comments can be instantly transmitted to millions of people throughout the world and live on, so to speak, in electronic files that may never be fully expunged.
Personal Injuries follows The Laws of Our Fathers, which Turow completed in 1996. His latest novel is set in the fictional Kindle County, which has much of the atmosphere and many attributes of Chicago, the city in which Turow and his wife practice law. The IRS has located a bank account into which large amounts of money have been deposited by those associated with a small law firm. The account appears to be a device to hide income, and the IRS immediately puts the pressure on Robbie Feaver, one of the two partners in the firm. The real problem for Feaver began when the IRS agents opened his front door to let in U.S. Attorney Stan Sennett, who had an entirely different goal than tax recovery on his mind. That is when George Mason got involved. Mason was an attorney who had an office in the same building where Feavers firm had its offices. Mason becomes the voice of the novel as Feavers attorney for the defense of the tax fraud charges. The story is told largely from his point of view as he attempts to help Feaver through what becomes a complicated hodgepodge of personal relationships, schemes, double-dealing, subterfuge and, ultimately, death. It seems the U.S. Attorney is interested in leveraging the potential tax charges against Feaver to force Feavers cooperation in a sting operation. The target of the sting is Feavers law partners uncle, the chief judge of the local court. U.S. Attorney Sennett believes there is widespread corruption in the courts. Feaver confirms that he has been involved in a system by which he can influence the outcome of cases favorably. The system involves giving money to various people who work for different judges, and the belief is that some of the money in each case makes its way to the chief judge.

The Concrete Centres activities and achievements have made significant progress during 2006. The UK has one of the lowest per capita consumptions of cement and concrete in the world. The Concrete Centre has been set up to address this by ensuring that the key decision makers and influencers in the construction industry are made fully aware of the wide range of benefits and attributes that concrete has. The most critical project stages that assist in the formulation of a decision as to whether or not to go with concrete are the feasibility study and detailed design. It is at these stages that the frame material is determined. Therefore, it is essential that the decision makers involved are able to make a fully informed choice in terms of structural design, construction methods, fire performance, environmental and acoustic performance and thermal efficiency. We in the concrete industry need to ensure that best practice information on the most efficient forms of concrete construction is available to design teams. The resources and advice provided by The Concrete Centre prove invaluable at this critical stage of the design process.
No retrospective would be complete without remembering the contributions of leading figures who have helped shape the industry. In this issue recognizing todays top contractors (see page 27), it is fitting to salute some of the pioneers from CONCRETE CONSTRUCTIONS early days. It was Corbettas dedication to the development of a strong concrete industry, however, that earned him the moniker Mr. Concrete. He was instrumental in founding several organizations, starting in 1950 with the Concrete Industry Board of New York City, which brought together concrete contractors, producers, architects, engineers, testing labs, cement manufacturers, and reinforcing steel producers.

Millions are at stake. In such circumstances, when are they not? The pictures gain something of the aura of holy relics. The money thats gone into them, before the hooch launches on the international market, is completely crazy. All spent in the service of image. Theres been some slight consternation at NI Towers around doing an issue on advertising. We advertise ourselves and print ads in the magazine. Might there be just a whiff of the double standard? But theres a gulf between our efforts and those of big-brand mass advertising that stretches from here to, well, almost eternity. We constantly remind our contributors theyve got to help us live up to our advertising promises. We print only a few ads in the NI–those that meet our guidelines and which might have something to offer our readers. And we cherish our independence–weve never had to bin a piece because it might have upset an advertiser. Bins are for junk.

Real estate practice is a broad and widely defined area of the law. In a pristine sense it deals with the esoteric subject of real property law and titles. In practice the subject matter handled by real property lawyers is much broader. Many of the areas of law within real estate practice are areas of specialty themselves. Real estate lawyers examine and evaluate real property titles, handle real estate sales, purchases and other transactions, foreclose mortgages, represent developers and contractors in drafting and negotiating development and construction agreements, handle real estate financing, structure and draft the governing documents for planned developments such as condominiums, serve as counsel to community and condominium associations, draft and negotiate leases, litigate title, boundary, and other land disputes, and advise clients respecting zoning and land: use matters. The examination of real estate titles requires knowledge of corporations and other forms of business organization, wills, trusts and estates, and a practitioner handling transactions must understand contractual, business, and tax subjects as well. The subjects that are tested on the certification exam attest to this diversity. They are title issues; real estate finance; environmental and land use; condominiums and homeowner associations; landlord tenant; closings; sellers, buyers, brokers, and title insurers; real property litigation; taxation of entities and other tax issues; and ethics. Some hold an impression that at least some aspects of the real estate practice are not challenging, that the practice is increasingly title company, form, and paralegal driven, and that when business is light any lawyer with a good paralegal can Ado real estate closings. This impression is not accurate. As with any area of practice, successfully representing clients in real estate matters requires knowledge, skill, and experience. The diversity in real estate practice may mean that no one lawyer can be an expert in each practice area encompassing the modern real property practice or that are tested by the certification program. The committee recognizes that few lawyers are likely to possess specific and detailed expertise in each of the many subjects that fall within the scope of real estate.

Call it catalytic conversion: remodeling cleaned up this small kitchen and helped it function more efficiently. Before, though the sink and most appliances seemed to be in the right places, there wasnt quite enough counter space. And heavy-looking painted wood cabinets and a crowded breakfast area made the entire kitchen seem cramped. For more comfortable seating, a built-in bench now wraps a corner of the eating area. The windows were restyled, with a new one added to the kitchens long wall; the breakfast areas section of this wall was pushed out about 1 1/2 feet.
Out for views, up for light: those are the directions this tall, four-sided bay takes to gain garden views. Since the shallow pitch of the existing roof would have cramped the high, open greenhouse look the Starrs wanted, designer Linda Thornton of Carmel, California, gave the bay an octagonal roof of its own. It rises almost 3 feet above the existing roof, radiating from a central point above the eave line. Half of it notches into the old roof; the other half extends beyond to top the four glass walls. Only three support posts obstruct garden views through the glass panes. Outside, a planter wraps around the base of the bay, softening the expanse of concrete patio.

No shortage of storage in this kitchen remodel Chock-full of storage, this generous kitchen addition was annexed to the rear of the house. Among its space-expanding amenities are a 5 1/2-foot-long appliance garage, an eating and storage island, and a built-in desk for menu planning. Heart of the kitchen is a six-sided 9 1/2-foot-long island that provides storage for dishes, knives, and spices, as well as a cooktop and a snack counter serving four. Who knows what evil lurks in the hearts of men?Under newer and tougher standards, auditors are more involved than ever before in reducing the incidence of financial fraud. Statement on Internal Auditing Standards No. 3 requires the internal auditors to recognize the characteristic warning signs of internal fraud. Certified Fraud Examiners, many of whom have an audit background, are required to resolve allegations of fraud. Statement on Auditing Standards No. 53, promulgated by the Auditing Standards Board of the American Institute of Certified Public Accountants, requires external auditors to be more proactive in searching for fraud. Statement on Auditing Standards No. 54 requires the independent auditor to recognize major illegal acts, and in some instances report them. Legislation pending in the U.S. Congress may mandate even tougher standards.To meet their ever-expanding responsibilities in the area of fraud deterrence, internal auditors must be more “fraud-savvy” than ever before. During the last five years, Ive conducted interviews with McKinley Tabor and a few dozen other offenders. There is a lot we can learn from these financial Frankensteins.
Most financial conglomerates in Norway are mainly engaged in hanking activities. Chart 3.1 summarises hanks assets and Huhilities. Loans to Norwegian households and enterprises account tor approximately two-thirds of hanks assets. Developments in credit risk are therefore of central importance for banks* earnings and for financial stability. This section primarily focuses on an analysis of hanks and changes in financial infrastructure. Developments in other financial institutions arc discussed in brief. Banks results have been solid so far this year. However, banks total pre-tax profits as a share of average total assets declined somewhat compared with the same period last year (see Chart 3.2). Rather than looking to the monetary aggregates as the cause of a crisis, the asymmetric information literature looks at a broader range of microeconomic factors such as the failure of a major financial institution, sharp declines in particular asset prices, disruptions in a particular financial market like the foreign exchange or commercial paper market, and so on. Thus, whereas the monetarist view focuses on bank panics and monetary aggregates to explain crises, the asymmetric information theory looks at more particular microeconomic failures in institutions or markets.

The drama of mergers, acquisitions, downsizing, and the managed redirection of health care resources away from acute care hospitals and high-technology medicine has overshadowed another change in the contemporary health care culture (Duva, 1990; Edmonds Hallman, 1995; Gabel, 1997; Salmon, 1995). The purpose of this article is to discuss the growing interest in alternative health care and offer an explanation for this phenomenon. Alternative health care is not easily defined. Often it is explained by describing what it is not — the scientific practice of nursing or medicine as it has come to be understood in first world countries during this century. Physicians who are sympathetic to the movement say that alternative therapy encompasses a broad spectrum of practices and beliefs (Eisenberg et al., 1993), and reflects a holistic world view of health and illness that is outside the biomedical mainstream of medicine (Rauckhorst, 1997). Other writers compare and contrast traditional and alternative medicine as a way of defining its practice. Western medicine is specialized; alternative care is holistic. Scientific practice is evaluated by its outcomes and its coherence with protocols; alternative therapy is not in conformity with the standards of the medical community and is considered to be unorthodox. Little is known about its safety, efficacy, or effectiveness (Gevitz, 1988; Lohr, 1997; U.S. Congress, 1990). The science of medicine is taught and practiced in universities and hospitals; alternative care is not widely taught is U.S. medical or nursing schools and is generally unavailable in American hospitals (Eisenberg et al., 1993; Engebretson Wardell, 1993). Insurance companies and federal and state governments pay for traditional medical care. With few exceptions (acupuncture and chiropractic medicine), alternative therapy has not been included as a health benefit by health insurance companies (Eisenberg, 1997). Recently, however, Oxford Health Plans announced its intention to offer coverage for alternative health care and provided its enrollees with a list of providers and services (Oxford Launches, 1998). There is an elaborate certification and licensing system for health care providers and hospitals; the world of alternative therapy is unregulated and its practitioners are usually unlicensed and uncertified (Eisenberg, 1997).
Sir: The risks of unregulated and irresponsible alternative medicine are rightly highlighted in your report of the article in the New England Journal of Medicine (”Alternative medicine a health risk, say experts”, 17 September). The public may be unaware that in many areas the evidence base for orthodox medicine is non-existent, and the potential for harm substantial. The evidence base for medical homeopathy is far from complete. However, one example of the many supportive studies is as follows. Of a group of 506 outpatients at the Royal London Homeopathic Hospital with a range of conditions including back pain, arthritis and allergies, 81 per cent improved with regard to their main problem and 80 per cent in their overall well-being. Of the 300 who were on conventional drugs at the outset, two- thirds reduced or stopped them.

LEADING ARTICLE Tutankhamun T he news that Tutankhamuns “beautiful face” and “wonderful smile” have been restored to us in all their glory is cheering to those of us whose looks are going after only a few decades. Isnt it heart-warming that one can look so good after more than 3,000 years in a coffin underground? And of course, if Tut can be restored and “brought back”, albeit in a virtual sense, more than three millennia after his death, it begs the question of who will get the same treatment 3,000 years hence.

Financial Statement Disclosures for Financially Troubled Enterprises Readers of financial statements of companies operating under chapter 11 generally recognize the financial statement disclosures required by the American Institute of Certified Public Accountants (AICPA) Statement of Position 90-7, “Financial Reporting by Entities in Reorganization Under the Bankruptcy Code” (SOP 90-7). As required by SOP 907, financial reporting during reorganization proceedings should distinguish transactions and events that are directly associated with the reorganization from those related to a debtors ongoing business operations. The distinction between the reorganization and the ongoing business is made on each of the debtors principal financial statements. On the balance sheet, the debtor separately classifies pre- and post-petition obligations, distinguishing those pre-petition obligations that are subject to compromise from those that are not. Reorganization- and restructuring-related income and expenses are separately presented on the statement of operations. Within the operating, investing and financing categories of the statement of cash flows, cash flows in each of those categories resulting from the reorganization process itself are separately presented.
